1Acceptance of terms

By downloading, accessing, or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree to these Terms, do not use the App.

2Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement and that you are not barred from using the App under any applicable law.

3The service

Spira helps you build habits by letting you track them, earn in-app tokens for completing them, and "spin" to win rewards that you define for yourself. We may add, change, or remove features at any time, and we may set or modify limits on the use of the App. We strive to keep the App available and reliable, but we provide it on an "as is" basis and do not guarantee uninterrupted access.

4Tokens & rewards

The App uses a playful "casino" theme, but it is a habit-tracking and self-motivation tool — not a gambling product.

• No real-money gambling. The App does not offer gambling, betting, or games of chance for money or anything of monetary value.
• Tokens have no value. In-app tokens are a motivational mechanic only. They have no monetary value, cannot be purchased with real money, and cannot be redeemed, exchanged, transferred, or cashed out for money or any real-world currency.
• You define the rewards. "Rewards" are entirely user-defined — things you choose to grant yourself (such as a treat, a break, or an activity). We do not provide, fund, fulfill, or guarantee any reward. Fulfilling a reward is your responsibility.
• The "spin." The spin and odds are an in-app gameplay feature designed to make completing habits more engaging. Outcomes do not entitle you to anything of monetary value.

5Your account

Some features may require an account. You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized use.

6Acceptable use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms;
• Attempt to reverse engineer, decompile, or extract the source code of the App, except where permitted by law;
• Interfere with, disrupt, or place undue load on the App or its infrastructure;
• Access the App through unauthorized means, or attempt to circumvent security or usage limits;
• Upload content that is unlawful, infringing, or harmful, or that you do not have the right to share;
• Use the App to harass, abuse, or harm another person.

7Purchases & subscriptions

The App may offer optional paid features or subscriptions. Any purchases are processed by the Apple App Store or Google Play and are subject to their terms. Prices and offerings may change. Unless required by law, payments are non-refundable; refund requests are handled by the relevant app store. Subscriptions renew automatically unless cancelled in your app store account settings before the renewal date.

To be clear, any purchase relates to App features or content — it never involves buying tokens for gambling, and tokens can never be bought or cashed out.

8Intellectual property

The App, including its design, branding, text, graphics, and software, is owned by Spira or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms. You retain ownership of the content you create (such as your habits and reward names); you grant us the limited rights needed to operate the App and provide it to you.

9Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Spira is a motivational tool and does not provide medical, psychological, financial, or professional advice. We do not warrant that the App will be uninterrupted, error-free, or that it will achieve any particular outcome.

10Limitation of liability

To the maximum extent permitted by law, Spira and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App. To the extent liability cannot be excluded, our total liability is limited to the greater of the amount you paid us in the twelve months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the App. Provisions that by their nature should survive termination — such as intellectual property, disclaimers, and limitation of liability — will survive.

12Governing law & disputes

These Terms are governed by the laws of [Governing jurisdiction], without regard to its conflict-of-law rules. You agree that any dispute will be resolved in the courts located in [Venue], unless applicable law grants you the right to bring proceedings elsewhere. Nothing in these Terms limits any mandatory consumer-protection rights you have under the law of your country of residence.

13Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the App. Your continued use of the App after changes take effect means you accept the revised Terms.
